A birth injury is any physical harm to a baby or mother that occurs during pregnancy, labor & delivery, or shortly after birth. These injuries are not caused by a baby’s genes, but by trauma during the birth process.

A child may suffer throughout his or her life because of cerebral palsy, one of the most common conditions resulting from trauma at birth. This serious condition can limit people’s ability to control their body movements. They may have stiff muscles, uncontrollable movements, and poor balance and coordination.

For every 1,000 U.S. births, six to eight of them will suffer a birth injury. This accounts for around 2% of neonatal deaths and stillbirths.

  • C-section mistakes

Birth Injury Caused by Inadequate NICU Care

Many of the above-mentioned complications require babies to be treated in the Neonatal Intensive Care Unit (NICU). Sadly, poor performance in the NICU sometimes leads to further injury.


For example: if a baby’s blood sugar is not properly monitored and drops too low, severe brain injuries can occur. Or, if jaundice is not adequately treated while a child is in the NICU, bilirubin can build up and cause a form of brain damage called kernicterus.
